HAZMAT Register

A Hazardous Materials Register (“HAZMAT Register”) usually includes but is not limited to:

  • Asbestos Containing Materials (ACM)
  • Synthetic Mineral Fibres (SMF)
  • Polychlorinated Biphenyl’s (PCB)
  • Lead Paint and Dust
  • Ozone Depleting Substances (ODS)

Meeting your obligations under WHS & OHS Law

WHS and OHS Laws mandate specific responsibilities for the management of hazardous substances/materials and place a Duty of Care upon “Persons with Control” or “persons conducting a business or undertaking” (PCBUs) the to ensure exposure is minimised. It is mandatory to identify Hazardous Materials and manage them in a safe manner.

Regulations require that “Persons with Control” of workplaces or “persons conducting a business or undertaking” keep an accurate HAZMAT Register.

“Persons with Control” or “persons conducting a business or undertaking” (PCBUs) include:

  • Premises owner or occupier
  • Employer
  • Manager
  • Other representative with responsibility for workplace repairs or alterations
  • Landlords

All workplaces containing Hazardous Materials must have a HAZMAT Register (HR) and an HAZMAT Management Plan (HMMP).

A HAZMAT Register and an HAZMAT Management Plan are often confused. Although similar, and usually prepared at the same time, they are different documents with different functions. The fundamental difference is:

  • HAZMAT Register documents where hazardous materials have been found
  • HAZMAT Management Plan describes the processes in place for dealing with hazardous materials

A HAZMAT Register and associated HAZMAT Management Plan are specific to each site and copies must be available for inspection by employees, tradespeople and other visitors.

Do I need a HAZMAT Register?

A HAZMAT Register and HAZMAT Management Plan are not required if:

  • no hazardous materials identified during a HAZMAT Survey

It is a legal obligation to have an HAZMAT Register and HAZMAT Management Plan if:

  • Hazardous Materials (especially asbestos) have been identified at a workplace

What is a Compliant HAZMAT Register?

A compliant HAZMAT Register is a document that lists all identified (or assumed) hazardous materials in a workplace, and must:

  • Record any hazardous materials that have been identified
  • Include:
    • the date on which hazardous materials were identified
    • the material type, extent, location, condition  and accessibility
    • details of any hazardous materials (especially asbestos) assumed to be in the workplace
    • results of any analysis that confirms presence of a hazardous material at the workplace
    • details of inaccessible areas
    • photographs and/or drawings to visually show the location of hazardous materials (especially asbestos) in the workplace
    • ACM posing little hazard (e.g. mastics, roofing felts etc.) to document they have been considered, found to be of minimal risk, with no specific actions required

Regardless of any changes, the HAZMAT Register must be reviewed annually and revised if necessary, to keep it current.
